Munich, 27 February 2023 – LPA-GGV acted as legal counsel to Schienenfahrzeugwerkstatt Regensburg GmbH & Co. KG (SFWR) in connection with the financing by Norddeutsche Landesbank – Girozentrale (NORD/LB) of the acquisition and further development of the workshop for rail vehicles in Regensburg initially erected in 2021. The parties have agreed not to disclose the financing volume.

The workshop is let to agilis Eisenbahngesellschaft mbH & Co. KG (agilis) in order to carry out maintenance works of the extended rail vehicles fleet for the operation of regional rail services in the Regensburg-Donautal network. Agilis was awarded with the concession to operate the regional rail passenger transport services for the Regensburg- Donautal network by the relevant authorities (Bayerische Eisenbahngesellschaft mbH and the Baden-Wüttemberg Ministry of Transport) on May 17, 2021. The underlying transportation contract has a term until the end of 2036 with operation commenced in December 2022.

LPA-GGV advised SFWR on all legal aspects of the transaction. The LPA-GGV team was led by  Andreas Feuerstein (Partner, Banking & Finance) and Dorothea Schimmel (Partner, Banking & Finance, Real Estate). They were assisted by, Jacqueline Spletter (Associate, Banking & Finance) and Aleksandra Hallberg (Senior Associate, Tax).

NORD/LB was advised by an Ashurst team consisting of the leaders Partner Derk Opitz and Senior Associate Alexandra Heitmann as assisted by Senior Associate Dr. Jan-Ulrich Heinemann, Associate Patrick Rauch and Transaction Lawyer Rina Axhimusa (all Project Finance, Frankfurt).

LPA-GGV already advised on the rail vehicles financing for the Regensburg-Donautal railway network in 2021. LPA-GGV regularly advises clients on asset finance transactions in the context of SPNV financing and now for the second time also in connection with workshop financing.
